DePuy Hip Recall Lawyers Prepared to Fight

Stephen Axelberg is a patient of the DePuy ASR hip replacement system. Mr Axelberg, from Georgia, recently filed a Depuy Hip Lawsuit against DePuy—a subsidiary of parent company Johnson & Johnson—because of the complications he has experienced as a result of his ASR hip replacement system. He is far from alone in this, however – many patients have experienced DePuy Hip failure and other problems with their hip replacement systems, and DePuy even went so far as to voluntarily recall the product in August of last year. 

Axelberg’s lawsuit claims that DePuy knew of the risks associated with their ASR hip replacement system as early as 2008, as admitted by one of the designers of the ASR hip device, Dr. Thomas Schmalzried. However, DePuy did not admit anything about the potential for side effects until early 2010, and DePuy Hip Recall the device only a few months later.
Mr. Axelberg was fitted with the DePuy ASR hip replacement system in 2008, and after only a few months his hip’s health began to deteriorate. It was only when DePuy announced the recall of the ASR device that he realized that his problems likely had something to do with defects in the device. He, like many other plaintiffs who have filed suit against DePuy, is seeking damages in the form of compensation for medical bills and lost wages and earning power, as well as other general damages.

Like many victims of the DePuy ASR side effects, Mr. Axelberg is going to have to undergo hip revision surgery, which will be another cost on his medical bills and is also much more likely to be a cause of complication than the first surgery would have been. Statistics have shown that about 12 percent of patients who received a DePuy ASR hip replacement system have had to undergo revision surgery. Taking into consideration that at least 90,000 people have received an ASR hip replacement device, this could mean that as many as 11,700 people will have to undergo hip revision surgery – and many of these people are likely to file a lawsuit.
