Florida DePuy Hip Lawsuit Alleges Chronic Pain


Carol Ann Agostini filed her DePuy hip lawsuit on January 3, 2012, alleging that she had received a defective ASR hip implant in 2008. Through her DePuy hip lawyer, the plaintiff claimed that the allegedly failed implant had caused her "severe and possibly permanent injuries," and that her only recourse may be DePuy hip revision surgery. Agostini is the recipient of a DePuy ASR XL Acetabular Hip Replacement System, which was subject to DePuy hip recall in 2010.

DePuy Hip Lawyer Cites Permanent Injuries
Through her DePuy hip lawyer, Agostini filed her case in United States District Court in the Middle District of Florida. The lawsuit names DePuy Orthopedics as defendant, and alleges that the plaintiff received a DePuy ASR hip implant on August 26, 2008. The plaintiff's DePuy hip lawyer claims that Agostini began experiencing DePuy hip complications, including hip and knee pain, immediately following her surgery. The plaintiff also alleges that she suffers from chronic pain related to her DePuy hip implant, and that her discomfort is so severe that it prevents her from standing for extended periods of time.

DePuy Lawsuit Alleges Corporate Negligence
Agostini's DePuy lawsuit accuses DePuy Orthopedics of negligence related to the design, manufacture and marketing of their DePuy ASR XL Acetabular Hip Replacement System. Furthermore, the plaintiff alleges that DePuy's negligence has caused her mental anguish, disability, loss of enjoyment of life, disfigurement, bodily injury, and lost earning capacity. The plaintiff asks the court for damages for her injuries, and also compensation to cover hospital and medical expenses.

DePuy Hip Recall News
On August 25, 2010, the ASR Hip Resurfacing System, ASR XL Acetabular Hip Replacement System, and all associated components were subject to a DePuy hip recall. In a letter to medical professionals, DePuy explained that these devices and their components showed a higher-than-average failure rate. The company also stated that it planned to suspend sales of the ASR XL Acetabular Hip Replacement System, since this product had witnessed a decline in demand.

Unfortunately, many patients had received DePuy hip implants before the 2010 recall, and were already reporting DePuy hip complications including metal poisoning, bone fracture, implant loosening, implant dislocation, and other symptoms of DePuy hip failure. For some, like Agostini, the only recourse may be DePuy hip revision surgery.
