DePuy ASR Hip Lawsuit Status Conference Scheduled for Nov. 22


DePuy hip lawyers involved in federal lawsuits alleging injuries from the DePuy ASR Hip Resurfacing System and the DePuy ASR XL Acetabular system are preparing for the next DePuy ASR hip lawsuit status conference, which has been scheduled for Nov. 22 in the federal courthouse in Toledo, Ohio, which is where the MDL has been consolidated. The conference was called by federal District Court Judge David A. Katz, who is managing the MDL. The previous DePuy ASR hip lawsuit status conference was held in San Francisco, California on July 26. These status conferences are part of the discovery process, in which all the parties in a lawsuit and their attorneys are given all the information and facts on both sides so they may be fully informed before the actual trial.


More Recent DePuy Hip Lawsuits

The Ohio DePuy ASR Hip Lawsuit Status Conference is expected to follow the same format as the previous one. At that conference, DePuy hip lawyers were told to submit a Plaintiff Fact Sheet and Medical Records Authorization for each client who had gone through, or was planning to go through, DePuy revision surgery. DePuy hip lawyers also have to produce documents to support their claims against the defendant. All this information is given to the defendants' attorneys so they are fully informed of the nature of all alleged injuries and what was done about them. Both of the DePuy ASR systems were recalled on August 10, 2010.

Meanwhile, lawsuits involving another DePuy hip replacement device, the Pinnacle hip, had a status conference on August 9, 2011 in Texas at which DePuy hip lawyers likewise submitted Plaintiff Fact Sheets and Medical Records Authorizations. Both the ASR and the Pinnacle had problems caused by metal-on-metal components which can wear away with friction, leading to premature loosening of the device, hip displacement, bone fracture, and/or metal poisoning (which can occur when metal debris scrapes off the device and gets into the bloodstream). Although the Pinnacle has not been recalled, thousands of lawsuits alleging injury from the device have been filed and consolidated in the Pinnacle hip lawsuit MDL in Texas.
