A 21-year-old Tucson, Arizona woman has become one of the youngest plaintiffs to become involved in the ongoing DePuy hip multidistrict litigation centered in Ohio. Cassandra Eubanks filed her DePuy hip lawsuit on January 10, 2012, after experiencing pain and DePuy hip complications as a result of her DePuy hip implant. Eubanks, who received her implant when she was only 15, allegedly experienced pain in her groin, right hip, and lateral hip area radiating down her thigh after the device was implanted in her right hip.
The lawsuit filed by Eubanks' DePuy hip lawyer also claims that Eubanks experienced increased heavy metals, including chromium and cobalt, in her bloodstream. Like many plaintiffs involved in DePuy lawsuits, she was forced to undergo revision surgery in 2011 to have the device removed. The lawsuit filed by her DePuy hip lawyer alleges that the injuries she suffered were directly correlated to the failure of her right hip implant.
Eubanks was supposedly not warned of the dangers of her implant until she learned of the DePuy hip recall that took place in 2010, and this fact has led to allegations that DePuy continued to market its product to patients even after they became aware of the potential for hip failure and clinical findings that ended up leading to 2010's recall of the devices. Her lawyer is seeking compensatory damages that will help cover pain and suffering both mental and emotional. These damages will also cover past and future medical expenses and compensate for emotional distress. She is also seeking punitive damages from DePuy.
The 2010 DePuy hip recall was voluntary, as the orthopedics manufacturer's parent company Johnson & Johnson issued it after multiple studies showed a higher than expected failure rate that was linked to use of the device. Many plaintiffs have filed lawsuits after their hip replacement systems failed, seeking damages much like the ones Eubanks has filed for. Many of these lawsuits, including that of Cassandra Eubanks, have been consolidated in multidistrict litigation, which will take place in the United States District Court for the Northern District of Ohio.
Most of the time, i hear only victims who are in 50-60 age bracket. The young woman is too young for hip recall!
